Texas birth records under 75 years old are closed to the general public. Only qualified applicants can receive certified copies. Qualified applicants include the person named on the certificate, their parents, siblings, grandparents, spouse, legal guardian, or legal representative.

To request a birth certificate, you need to give the clerk enough information to find the record. That includes the full name on the birth certificate, the date of birth, the place of birth, the father's full name, and the mother's full maiden name. You also need to show a valid photo ID. If you are requesting the record for someone else, you need proof of your relationship to that person.

For records from other Texas counties, the Nacogdoches County Clerk can access abstract copies going back to 1926 through the statewide remote system. Anyone born in Texas before 1926 in another county must contact that county directly. Remote access records are abstract copies and may not work for passport applications.

You can also use the Texas DSHS online system. Visit dshs.texas.gov/vital-statistics or call (888) 963-7111. Online orders are processed with a credit card and can be faster than a mail request.

Birth Certificate Fees

Birth certificates in Nacogdoches County cost $23.00 for the first certified copy. If you order more than one at the same time, each additional copy is $4.00. Death certificates are $21.00 for the first copy and $4.00 for each additional copy ordered at the same time.

Payment options vary by location. For in-person visits, most offices accept cash, check, or money order. Mail-in requests require a check or money order made out to the Nacogdoches County Clerk. Do not mail cash. If you are ordering through the Texas state system online, a credit card is required.

Birth Record Privacy and Access

Texas law protects birth records for 75 years. This comes from Texas Health and Safety Code Chapter 191. The law defines who can request a certified copy of a birth record and the steps required. Once a record is more than 75 years old, it becomes public and anyone can obtain it without proving a relationship.

Certified copies carry the full weight of the original. They can be used to prove identity, apply for a passport, get a driver's license, or enroll in school. The County Clerk issues certified copies with an official seal. Abstract copies, which can be obtained through the state's remote system, do not have all the same uses. For official purposes like passports, get a full certified copy from the county of birth.

Note: If you need a birth certificate for a U.S. passport and you were born before 1964, you may need the long-form certified copy rather than an abstract.
