Who Can Request a Birth Certificate
Texas law limits who can get certified copies of birth certificates under 75 years old. The person named on the record must be you, or you must be a close family member or authorized representative.
Qualified applicants under Texas law include: the registrant (if 18 or older), a parent listed on the birth certificate, a sibling, a child, a spouse, a grandparent, a legal guardian with proof of guardianship, or an attorney or legal representative with documentation. In cases where only the mother is listed on the record, access rules can be more limited depending on who is asking.
Birth records that are 75 years or older are public records. Anyone can request copies of these older documents. Genealogists often use these records for family research. The Texas State Library and Archives Commission may have older historical records on microfilm or in digital collections.
